This week on Gin & Justice, Amanda first tells us about some of the new laws targeting the trans population and youth, including criminal penalties for using bathrooms.  Justine then brings us back through a case analysis of the case Kennedy v. Louisiana, 554 U.S. 407 (2008).  This is the case which built off of Coker v. Georgia, in which the US Supreme Court held it was unconstitutional and a violation of the Eighth and Fourteenth Amendments to sentence an individual to the death penalty for sexual assault of a minor. Despite the US Supreme Court analyzing this, Florida has recently reenacted a statute the provides for the death penalty for sexual battery of a child, a penalty even the Florida Supreme Court has found unconstitutional in 1981.  So much for stare decisis.
